Confidentiality policy regarding the processing of Personal Data (PD)

Fiduciaire Comptable Luxconcept S.à r.l., hereinafter referred to as "Luxconcept", makes every effort to protect your privacy and to ensure that you can continue to entrust us with your personal data in complete security.

Luxconcept always manages personal data in a secure and discreet manner and takes all reasonable security measures (technical and organisational) to prevent the loss, alteration, unauthorised access, accidental disclosure to third parties and/or any other unlawful processing of personal data collected. We will always use your personal data fairly in order to be worthy of your trust.

Personal data is always processed in compliance with current European privacy regulations, including Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR" or "RGPD").

For the purposes of this privacy statement, "personal data" means: any information relating to an identified or identifiable natural person (the "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

By means of this confidentiality statement, Luxconcept intends to provide you with clear and transparent explanations on the personal data concerning you that is collected, on the purpose for which it is collected, on the use we make of it and on the persons to contact if you have any questions on this subject.

Luxconcept may modify or update this privacy statement to take into account customer feedback or to reflect changes in its processing activities.

2.1 When is personal data processed?

Among other things, we collect personal data when :

  • you visit our website;
  • you communicate personal data when using our website (including our pages on social networks), for example when you write to us using the website form;
  • you are becoming/will become a customer ;
  • contact us via the various channels available to you;
  • you complete or sign the forms and contracts that we submit to you;

  • Contact and personal identification details: surname, first name, postal address, e-mail address, telephone number(s), date and place of birth, registration number, VAT number and RCS/LBR number.
  • Other personal information necessary for the performance of the contract (including the provision of quality services): invoicing.

3. Why Luxconcept does it collect personal data?

Luxconcept collects and uses your personal data exclusively for the determined, specific and legitimate purposes listed below:

Types of personal data collected : Surname, first name, postal address, e-mail address, telephone number(s), date and place of birth, registration number, VAT number and RCS/LBR number.

Purpose : Management and execution of services.
Legal basis : Necessary for the performance of the contract.

4. Sharing of personal data by Luxconcept  

Luxconcept may share your personal data with a third party if it is required to do so either by virtue of a legal or regulatory obligation or by virtue of a constraint emanating from a public authority within the legal limits. Your data will therefore be stored and possibly transmitted.

Personal data is not transmitted outside the European Union.

 

5. Your rights concerning your personal data

You have a number of rights designed to give you greater control over the processing of your personal data. You will find more information below:

5.1 Right to unsubscribe from advertising messages

Any person concerned has the right to unsubscribe from information messages, advertising messages, proposals and offers for Luxconcept products and services.

If you are a customer and you indicate that you no longer wish to receive advertising messages, you should be aware that you may continue to receive messages from Luxconcept as part of the performance of your contract.

5.2 Right of access, rectification, restriction and objection

You always have the right to access your personal data.

You also have the right to ask Luxconcept to correct inaccuracies or incompleteness in your personal data. If you consider it necessary, you may also ask Luxconcept to restrict the processing of your personal data.

You may always object, free of charge, to the automated processing of your personal data.

5.3. Right to erase data

Under certain conditions, you may request that your data be deleted. In this case, however, you must take into account the fact that we will no longer be able to offer you a service if you so wish. However, your right to be forgotten is not absolute. We have the right to retain your data where necessary, for example:

  • compliance with a legal obligation ;
  • the establishment, exercise or defence of legal claims.

5.4. Right to withdraw your consent

Where your personal data is processed with your consent, you may withdraw this consent at any time by sending a simple request to Luxconcept.

5.5 Right to data portability

You also have the right, under certain conditions, to ask us to transfer to another controller personal data that you have communicated to us for the performance of the contract or for which you have given your consent. Where technically possible, we will send your personal data directly to the new controller.

5.6. Exercising your rights

You can exercise these rights easily and free of charge by sending us an e-mail to the following address: rgpd@luxconcept.eu. In order to verify your identity, we ask you to send us a copy of your valid identity document.

 

6. Data security and storage

6.1 Data security

Luxconcept has implemented various technical and organisational measures to protect your personal data against unauthorised access, use or disclosure. Luxconcept stores your personal data exclusively in secure and controlled environments that are accessible only to those employees who need it to perform their duties. The servers on which your personal data is stored are located in a controlled environment with limited access.

6.2 Conservation

Luxconcept will not keep your personal data longer than necessary. The actual duration of processing and storage is determined according to the purposes of the processing, taking into account limitation periods and any storage obligations arising from specific legislation (e.g. accounting and social legislation).
